MODULE 1: NEGOTIATION

Objectives of the Module:

  • developing the knowledge of the main negotiation strategies and techniques;
  • developing the ability to set a negotiation and analyze the context (the importance of supplier, the power of the parties, the expected length of the relationship with the supplier, the objectives);
  • developing the knowledge of the personal negotiation aptitudes that are generally used with the counterpart;
  • developing the ability to lead a negotiation trough the integration (win-win) model based on the Fisher and Ury’s theory;
  • developing the ability to recognize and neutralize the unfair tactics that the counterpart can use.

Methodology:

The guiding line of the course is using the classroom as a laboratory, a protected environment where recognizing and testing personal negotiation aptitudes and skills. The course mainly has an experiential nature, in order to let each participant observe and change his/her own behaviour repertory.
The evaluation instruments used during the Module are:

  • role playing;
  • feedback by other participants;
  • feedback by the trainer.

Objectives of the Module:

  • introduce general rules of the European Union applicable in public procurement;
  • make an accurate analysis of EU Directive 2004/18/EC and a general overview of the new Directive 2014/24/EU;
  • make an analysis of the WTO Agreement on Government Procurement (GPA);
  • introduce the accession to the GPA and define its potential benefits and costs;
  • analyze the UNCITRAL Model Law on Public Procurement.

Purpose of the Module:

The purpose of this module is to provide participants with a comprehensive knowledge of the principles, the policies, the rules and the procedures governing procurement under public sector projects financed by the major IFIs, with the focus on the policies of EBRD. Public procurement occupies a central place within the EBRD’s core objectives of fostering efficient use of public funds, contributing to institutional strengthening, corporate governance and internal capacity building.

Objective of the Module:       

At the end of this Module the participants will be able to clearly understand: (i) why procurement is important in IFI projects; (ii) IFI Procurement Policies and Rules; (iii) how to apply the advantages of sound Procurement and the IFI’s Procurement Policies; (iv) how to identify main procurement issues during project implementation in real life; (v) The role of the IFI’s on procurement supervision; and (vi) contract management techniques and  strategic tools within the context of international public procurement procedures and empirical evidence

Objectives of the Module:

  • learn about common approaches to anticorruption in procurement, from bid remedies to anti-fraud measures;
  • identify common patterns in anticorruption systems, such as corporate compliance and debarment systems;
  • give an understanding of the legal framework associated with the control of corruption in public procurement process, including the relevant provisions in the WTO Government Procurement Agreement, the UN Convention Against Corruption, the UNCITRAL Model Procurement Law and EU Procurement Directives;
  • give a practical understanding of the types of corruption that procurement practitioners face in practice during the course of procurement processes;
  • provide an understanding of the governance and structures that can be used to combat corruption.

Objectives of the Module:

  • analyze the legal background of PPP in an international perspective, taking into account different PPP types and roles in financing infrastructure;

Objectives of the Module:

  • introduce students to the stakeholder theory, definition of quality, quality management and quality improvement;
  • analyze ISO 9001 Certification and its relation with procurement;
  • illustrate how to measure customer satisfaction;
  • introduce students to quality inspections;
  • introduce students to EFQM Excellence;
  • explore the connections between green procurement, management tools, sustainability and environmental policy instruments;
  • describe what is green public procurements, its main drivers and befits, the main drawbacks experienced by public officers, and how a green tender can be designed according to the European legislation;
  • describe the functioning of an environmental management system and how it can be used as an environmental criteria in a green tender;
  • explore the role of life cycle perspective and ecolabels.

DISTANCE LEARNING

  • Before the starting of the program students will have access to a detailed reference list reviewing the fundamental concepts on the core subjects of the course which include law, economics and procurement management.
  • At the end of the in-class period students go back to their home countries and are required to participate in the final distance learning module. This is a 30 hours module on Procurement in Fragile Contexts delivered on Zoom in Autumn. The usual schedule is one 6-hour-lecture per week.
